This paper is about the applicability, control and transparency in the actions of the Brazilian public administration. Faced with many discussions it seeks to show the aspects of "being legal" of public organizations in a vast environment of administration. It can be concluded that the public administration, has the function to implement the principle of publicity and encourage citizen participation in the trial of public accounts in which the Court of Audit of the Union is the supervisory body that curbs possible misappropriation of resources, aiming at administrative transparency. In this context, this article is the result of a research with the objective of analyzing the importance of external control, enforceability of legality and transparency in the planning and execution of actions in the public organization. However, the use of bibliographic research grounded in Administrative Law, having the temporal limit of the Federal Constitution of 1988 and the Fiscal Responsibility Law. To give veracity and theoretical sustainability to the study studies of renowned authors in the area of Public Administration were used.
