The present case, which will be analysed, concerns trafficking in persons who have committed the crime of illicit trafficking in scheduled substances subject to control, as defined in article 220, paragraph 1, subparagraph d, of the Ecuadorian Comprehensive Criminal Code.The main objective of this investigation is to determine whether, in the criminal proceedings against H.G.G. and others, the Public Prosecutor's Office correctly charged the defendants in accordance with their participation in the offence. In order to demonstrate the above, interviews were conducted with four lawyers specialized in criminal law, who were able to demonstrate that an inadequate accusation made by the prosecutor would result in the defenselessness of the accused, and therefore, would not have a solid defense in accordance with the degree of participation in a given crime.
