It aims to discuss the genuine spirit of democracy from the perspective of legal philosophy, and its relationship with the rule of law and constitutionalism. Most academics prefer to discuss democracy as a substantive concept. Dr Huang as a constitutional jurist, however, regards democracy only as a procedure, viz a mechanism. He argues that we only know how to use a mechanism well if we learn how it works. Democracy in his eyes is merely a procedure which lets citizens make political decisions; however, this procedure establishes the most righteous sovereignty in a nation, which not only justifies the constitution but also makes sense the rule of law.
