Frustration or revision of contract due to an unforeseenable change in circumstances long has been debated in the literature and case law. Recently the subject was regulated in Turkish and German law. The relevant 2012 regulation in Turkey was inspired by the earlier corresponding regulation in Germany. This study provides a comparative review of these regulations and makes recommendations for improvement to both legal systems.
