A symposium entitled 'Protecting Investors through Capital Market Legislation' was held in November 2004 on the occasion of the 65th birthday of Eberhard Schwark. This focussed on the developments of capital market legislation in Germany and Europe. Capital market legislation has long since developed into a field of law in its own right, namely since the post doctoral thesis of Mr. Schwark 'Protecting Investors through Economic Law' (1979). The contributions of this symposium mirror the present volume. The 'Practical Seminar for Bank and Capital Market Legislation' established by Mr. Schwark at the Humboldt University of Berlin was again held from November 2004 until February 2005. The seminar gives students the opportunity to listen to external experts from real life as well as professors from other universities and to discuss a contemporary subject with them. Two contributions from this presentation complete the present volume.
